library copyright issues on youtube

I used music from the camtasia 8 library on a youtube video and immediately it was flagged for copyright infringement. The artist and song title we listed as a CD Baby artist.

I went to the CD baby page and the song was indeed the same song. So...

Is this music under some kind of royalty agreement with Camtasia where I can use it on monetized youtube videos? Or is it just music there for my to make personal videos that I can never share and monetize?

Hello,

Can you tell me what the song is called in the Camtasia Library that you used? Or did you download an asset from the TechSmith media page?

Those songs are free for our customers to use in their videos they share - personal, educational, business, etc.

The songs used from the Library should not be flagging in YouTube and I have only heard of this happening just one time over the years and that was long ago.

AS i mentioned in my original post the song for reference is Power of a Dream - John D. Morgan On CD Baby

In Camtasia it is called power of a dream

It was in the library when I updated camtasia today.

I have had to do some investigation on my end that has taken a while. I'm sorry for the delay.

There are two issues going on here, the primary is finding out what to do with YouTube flagging your content. This has happened a couple of time before but it is not a common occurrence so I had to find out what the process is and see if I could contact YouTube on your behalf.

So, I cannot contact YouTube for you. This is something you need to take care of through their interface from within your account. I do apologize for that!

There is a section at the end of your Camtasia Studio EULA, located in your program folder, that is called "Stock20 Standard End User Music License Agreement". This section contains the legal rights to use that music:

General Terms: You may use the Songs forever (in perpetuity) in an unlimited number of commercial and or non-commercial works or projects, provided that all use is in accordance with the terms and conditions of this Addendum.

That section is longer but this is the gist of it.

And, I did look at the original contract on our end to ensure that song, and the others I see in your Library are specifically covered by the Stock20 EULA within your Camtasia Studio EULA. And, they are.

So, if you let YouTube know this information, and send them the supporting EULA if you need to, that should take care of that situation and there should be no strike against your account.

I also apologize for the confusion about that song being in your Library. This stemmed from you saying your Library was auto-populated with that content when you upgraded.  Since we do not have any installer that auto loads those assets during any install or upgrade I was greatly confused and needed a bit of clarification from you. As far as I can tell, those are only available as single, ancillary download files from a webpage on our site. Overall, this part of the puzzle will just have to remain a mystery for now.

Nevertheless, those assets are part of the set covered by the Camtasia Studio EULA  - no matter if they were installed automatically or individually.

First of all thanks for your detailed reply and quick resolution to this. While I did not know about the EULA in the program folder I was referred to a document located here (http://assets.techsmith.com/Docs/pdf-camtasiaStudio/Camtasia_Studio_8_for_Windows_TSLA.pdf) that I used in my rebuttal to Youtube.

I have not heard back from them about it yet. I trust it will be sufficient.

As to the library, I have never manually downloaded any assets from any website. The library assets I have came as a result of installing this software. Either initially or with subsequent updates.

Hi Gerald,

I just wanted to confirm the exact name of the song you reference was what was actually displaying in your Camtasia Library.

We do not have any assets by that name, or that author, or from that CD. All of our assets are custom made for us by 3rd party vendors and they are all royalty free for use with Camtasia-created videos.

So, it could be at one time you downloaded that song from the Web and imported it into your Library.

Im sure you don't mean it that way, but it's kind of insulting when you tell me something that just isn't true.

Camtasia has been trying to get me to update forever. But I rarely do updates if I'm happy with something because technical issues often come with updates. But for whatever reason I was feeling adverturous today. When it said there was an update I decided to download it. Version 8.6

During the install process during the update it asked if I wanted to install the library. I did not know what to do. Would it overwrite what I already had? Would it simple add new stuff? So I came to this forum looking for answers. After about 10 minutes I was not able to find the answer. And since I was mid-install and wanting to move on with my life, I selected the option to install the media library with 8.6

After install was complete I was pleased to see all of my original stuff seemed to be there, along with some new stuff.

That track is the new stuff. I didn't go find it somewhere and install it. It's not anything I added to the library. It was added with this update.

So I understand that you don't believe it came with the Camtasia update, but all I can tell you is that you are incorrect.

I am attaching the screenshot off Camtasia opened and that song in the library, split into different lengths, just like all of your other assets are. This is 100% from your company.

And I'm hoping now Youtube doesn't negatively affect my account since I took the word of your company that all of your tracks with your software were approved and royalties were not an issue. A mistake I can promise you I will not make again.

Since it's obvious you do not even know what titles are in your libraries, you surely can't know if you have the rights to them.

I've rarely been this disappointed in a company or it's reply to my question. I have to tell you. Oh well. Live and learn I suppose.

I'm certainly not calling Kelly a liar, but I know that I've also experienced an issue one time with using music from the Camtasia library.

Since that time, I've totally avoided using the clips in Camtasia and have opted for what YouTube makes available just to be totally on the safe side. I believe YouTube is pretty unforgiving on this with something like a "three strikes and you're out" sort of policy.

I do recall from the distant past seeing another thread reporting YouTube issues related to copyright.

This all makes me wonder if there could be some bizarre pattern where YouTube falsely senses something? Not sure.

Old thread but I had the same problem just now - this song got flagged for copyright by YouTube out of the asset library.  Please advise.

I would try contacting support directly.
I don't use their music.Not because of this, I just don't care for it.

But I have seen this complaint posted many times over the years. I don't know what the best answer is or what goes wrong. But it seems like TechSmith owns some responsibility here.
I could be wrong. I don't know if theres scams that hijack copyrighted music, monetize it and  collect a check from Google. I suppose its possible?Seems unlikely.

You need to contact You Tube.Let them know you own Camtasia.They should be able to sort this out. I honestly don't know the proper procedure to straighten out the mess with You Tube.
But I'm sure its spelled out or there must be you tube videos covering it.

Techsmith actually has a FAQ directly addressing this I have since found.  It includes the EULA which I used to file a disputer over the copyright claim to YouTube, we will see what happens.
